Why do you think Jacob’s rival needed to become Locke?

I’m trying to figure it out because he becoming Locke didn’t allow him to kill Jacob. He still had to use Ben. So, why couldn’t he just communicate before with Ben and maybe promise him power or something if he killed Jacob for him. How becoming Locke allowed him to find the so called loophole?
