No one ever states that MiB can not kill candidates. Richard does say, however, that one can not die if he/she is touched by Jacob. Therefore, Jacob travels off-island to touch, and grant near-immortality to the candidates before MiB has the opportunity to kill them. Unfortunately for Jacob, his "touchees" can kill each other, and MiB can persuade them to do so. That is the loophole.
MiB does not need a body on the Island in order to impersonate them. We know this because MiB has appeared as Ben's mom as well as Isabella. But MiB can not impersonate someone who is alive--we have never seen him do this.
