Lostpedia takes copyright very seriously. In order to comply with copyright laws, we ask that users respect certain rules when uploading images onto the site, and add appropriate disclaimers. Please try to use the correct template whenever adding an image - its for the good of the site!


Basic Rules

1. Tag it with a template

Please tag images with a relevant copyright tag. These copyright tags allow us to acknowledge the people involved with the photography, and is fair use. When in doubt do not upload an image.

2. Description

Always try to use the description page to specify where it come from, (including episode of TV show or video podcast) and acknowledge the copyright holder of the image.

3. Please respect fair use

Fair Use means while we can use various images, including screencaps/screenshots from episodes, they are only to be used to illustrate the contents within an article. Galleries are not covered under this fair use remit.

For example, two images showing similar scenes, from wider or different angles are not needed on the same page. Just one of these images would be needed to illustrate the content within the article. Images that do not relate to the content are therefore, against fair use.

Templates

There are several templates available that allow you to tag images you upload to Lostpedia with the correct copyright information. Because in particular screencaps/screenshots of the show belong to ABC/Touchstone, we must make it clear that they own the image on the screen, and we are making use of "Fair Use" law within the United States (where Lostpedia is hosted) to allow us to use these to illustrate our articles. Lostpedia currently has a good relationship with ABC/Touchstone Pictures and Bad Robot Productions, and marking images with the correct copyright information is our way of showing good will back to the people who bring us the show we love.


If I upload a screencap/screenshot from an episode?

Copyrighted

This image is a screenshot of a copyrighted television program, video podcast or station ID. As such, the copyright for it is most likely owned by the company or corporation that produced it. It is believed that the use of a limited number of web-resolution screenshots

  • for identification and critical commentary on the station ID or program and its contents
  • on the English-language Lostpedia, hosted on servers in the United States,

qualifies as fair use under United States copyright law. Any other uses of this image, on Lostpedia or elsewhere, may be copyright infringement. For more information, see Fair use.

To the uploader: please add a detailed fair use rationale for each use, as well as the source of the work and copyright information.


Add {{Tv-screenshot}}. This copyright template is designed for use on any screenshots used of LOST, the LOST DVDs or any other material directly relating to video from the TV show or any of its spin-offs, including the LOST Experience.




If I upload an official company logo like ABC's?

This is a logo of a television station, network, corporation, or other organization, and is protected by copyright and/or trademark. It is believed that the use of low-resolution images of logos to illustrate the television station, network, corporation, or other organization in question on the English-language Lostpedia, hosted on servers in the United States, qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. Certain commercial use of this image may also be trademark infringement. Use of the logo here does not imply endorsement of the organization by Lostpedia, nor does it imply endorsement of Lostpedia by the organization.

If I upload a promotional photo of an actor or character?

This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.

The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide evidence of such ownership. Lack of such evidence is grounds for deletion.

It is believed that the use of low-resolution images of promotional material

  • to illustrate the work or product in question;
  • in the absence of free images that could serve such a purpose;
  • on the English-language Lostpedia, hosted on servers in the United States.

qualifies as fair use under United States copyright law. Other uses of this image, on Lostpedia or elsewhere, may be copyright infringement. See Copyrights for more information.

Add {{Promotional}}. Promotional photographs of the show or actors released by ABC, or the actors themselves, designed to promote LOST or the actor themselves via an image portfolio. Most of the images marked promotional will come from ABC Medianet [1]. Each image should have individual copyright applied in this case, via the summary options when uploading.



If I upload a GNU image, which sometimes looks like a clipart image?

Add {{LGPL}}. This license is mostly used within Lostpedia for images supplied by GNU, for their licenses, such as the Heckert the Gnu image that applies on the GDFL and LGPL license. This license is unlikely to have usage anywhere else within the site, as most images here are copyright of ABC, released to the public domain, or under Creative Commons Licensing.




If I upload something I know is common property, and so doesn't need copyrighting?

Public domain This image is ineligible for copyright as it has been released into the public domain, because it consists entirely of information that is common property and contains no original authorship.


Add {{PD-ineligible}}. Image is in the public domain and is therefore ineligible for copyright. Such images include the Trademark logo, or any image that are common property with no original ownership.




If I upload a photo or image that I myself have created, and allow Lostpedia to host?

Public domain en: This image has been (or is hereby) released into the public domain by its author, [[::User:{{{1}}}|{{{1}}}]]. This applies worldwide.

In some countries this may not be legally possible; if so:
[[::User:{{{1}}}|{{{1}}}]] grants anyone the right to use this work for any purpose, without any conditions, unless such conditions are required by law.


Add {{PD-User}}. Used for images, taken by Lostpedia members which have been release by that user into public domain use.




If I don't know what licensing template to add?

This is a general copyright template. The user who uploaded the corresponding file is unsure what copyright tag should be added, and so is using this box to flag to other users that this image needs sorting by someone with more understanding of US laws and fair use. This page will have accurate licensing shortly.

To the uploader: thank you for identifying this image as one that needs licensing added. It shall be resolved soon.

Add {{Unclassified}}. This flags the image file to other users that you are unsure what copyright template to add. This is perfectly fine, and others will see to it. Just the fact that you haven't simply left the file empty is enough.
